9. How does the change from exempt to nonexempt status affect my eligibility for overtime pay?

The change from exempt to nonexempt status qualifies you to receive overtime pay for time worked over 40 hours in a workweek and requires careful monitoring and reporting of your work time to ensure accurate compensation for your time worked. It should be noted employees are to only work beyond 40 hours if prior approval is received by their supervisor.  Working unauthorized overtime may result in disciplinary action.


Overtime Eligibility: As an exempt employee, you are not eligible for overtime pay regardless of the time worked beyond the standard workweek of 40 hours. However, as a nonexempt employee, you are entitled to overtime pay for time worked beyond 40 hours in a workweek.


Rate of Overtime Pay: Under the FLSA (Fair Labor Standards Act), nonexempt employees must be compensated for overtime at a rate of one and a half times their regular rate of pay. This means you will receive additional compensation for time worked beyond the standard 40-hour workweek.


Tracking Hours: With the transition to nonexempt status, you will be required to accurately track and report your time worked, including any overtime. This involves using the Campus Time and Attendance timekeeping systems to ensure proper documentation of your work hours.


Policies: UAB has specific policies and procedures in place regarding overtime eligibility, approval processes for overtime work, and how overtime hours are calculated and compensated. It is important to familiarize yourself with these policies to understand your rights and obligations as a nonexempt employee.
